Terms of Service for SCRAPYARDFINDER.COM

1. Agreement to Terms

1.1. These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User"), and SCRAPYARDFINDER.COM ("we," "us," or "our"), concerning your access to and use of the Service.

1.2. SCRAPYARDFINDER.COM is an aggregator service that collects, organizes, and presents information about scrap metal recycling centers ("scrap yards") and pricing for various types of scrap metal in the United States.

1.3. By accessing or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

2. Description of Service

2.1. Scrap Yard Aggregation: We compile and maintain a database of businesses involved in scrap metal recycling. This information is sourced from publicly available data as well as from submissions by company representatives.

2.2. Scrap Metal Price Aggregation: The Service automatically collects and displays scrap metal prices that companies publish on their official websites and other public sources.
IMPORTANT DISCLAIMER: All prices displayed on the Platform are for informational purposes only. We do not guarantee their 100% accuracy or timeliness. Prices can change frequently. You must always verify the current pricing directly with the scrap yard before entering into any transaction.

2.3. The Service acts solely as an informational intermediary. All transactions, financial agreements, and legal contracts are made directly between Users (e.g., individuals selling scrap and the scrap yards), without our involvement.

3. User Accounts and Business Listings

3.1. Adding a New Company: You may register on the Service to submit information about your scrap yard. You are solely responsible for the accuracy and legality of all information you provide, including names, addresses, contact details, and prices.

3.2. Claiming an Existing Listing: If your company is already listed in our directory (added by us from public sources), you may claim the listing to manage it. To do so:

  1. Register for an account on the Service.
  2. Send a request to our administration at 100saitov@proton.me, stating your company's name and the email address you used to register.
  3. Upon successful verification, we will grant you access to edit your company's profile.

4. User Responsibilities and Acceptable Use

As a User of the Service, you agree not to:

  • Provide any false, inaccurate, or misleading information.
  • Use the Service in any way that violates any applicable local, state, national, or international law or regulation.
  • Post or transmit any content that is unlawful, fraudulent, defamatory, obscene, or otherwise objectionable.
  • Infringe upon the intellectual property rights (e.g., copyright, trademark) of others.
  • Use the Service for any commercial solicitation (spam) or engage in automated data collection (scraping) without our prior written consent.

We reserve the right to terminate or suspend your access to the Service for any violation of these terms.

5. Intellectual Property Rights

5.1. User-Generated Content: You retain ownership of any content you submit to the Service, such as text, photos, and logos ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display that content in connection with operating and promoting the Service.

5.2. Our Intellectual Property: The Service and its original content, features, and functionality (including our design, text, and data compilations) are and will remain the exclusive property of SCRAPYARDFINDER.COM. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5.3. Aggregated Data: We may use the data collected on our platform (including prices and locations) in an anonymous and aggregated form for analytical research, statistical reports, and publications. This aggregated data is our intellectual property. If you use or cite our aggregated data in any publication, you must provide clear attribution to SCRAPYARDFINDER.COM as the source.

6. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the data practices described in the Privacy Policy, which is incorporated into these Terms of Service.

7. Disclaimers and Limitation of Liability

7.1. DISCLAIMER OF WARRANTIES: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2. LIMITATION OF LIABILITY: IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

8. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or your violation of these Terms of Service.

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by updating the "Last Updated" date of these Terms of Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
